In order to apply for an ITIN, you need to meet certain requirements. You’ll need to prove your identification, foreign status, and include certain documents with your ITIN application. Here are all of the eligibility and documentation requirements:

Eligible Persons

The first thing you need to do is figure out if you qualify for an ITIN. You may need to complete an ITIN application if you are:

- Someone who needs to report or file U.S. taxes but cannot get a Social Security Number.

- A non-resident alien who must file a U.S. tax return.

- A U.S.-resident alien who must file a U.S. tax return.

- A spouse or dependent of a resident alien or U.S. citizen.

- A spouse or dependent of a visa holder.

If you fit any of these descriptions, you can move forward with your W7 ITIN application.

Tax Return

You’ll need a federal income tax return from the IRS to get an ITIN. While you can submit your ITIN application at any time, if you apply after the tax return due date, you may need to pay penalties. 

Form W-7

Foreign Status and Identification Documents
